Welcome to Ovade Athletics ("Ovade"), operated by Ovade Holdings LLC. These Terms of Service ("Terms") govern your access to and use of Ovade's website, services, applications, consultations, coaching programs, assessments, video analysis services, recruiting guidance services, and related offerings.
By accessing the Ovade website, submitting information, applying for services, purchasing services, scheduling appointments, or participating in Ovade programs, you agree to be bound by these Terms.
By using Ovade's website or services, you acknowledge that you have read, understood, and agree to these Terms.
If you are under eighteen (18) years of age, a parent or legal guardian must review and accept these Terms on your behalf.
Ovade may offer services including, but not limited to:
Ovade reserves the right to modify, suspend, discontinue, or update services at any time.
You must be at least eighteen (18) years old or have the permission of a parent or legal guardian to use Ovade services.
By using Ovade services, you represent that all information provided is accurate and complete.
Payment is required before services are provided unless otherwise agreed in writing.
Payments are processed through third-party payment processors, including Stripe.
Ovade reserves the right to refuse, suspend, postpone, or terminate services for unpaid balances.
Appointments cancelled more than twenty-four (24) hours before the scheduled start time may be rescheduled without penalty.
Appointments cancelled less than twenty-four (24) hours before the scheduled start time may be charged the full service fee.
Failure to attend a scheduled appointment without notice may result in the full service fee being charged.
Ovade reserves the right to reschedule appointments due to illness, emergencies, scheduling conflicts, travel obligations, weather conditions, or circumstances beyond reasonable control.
Completed services are non-refundable.
Analysis services may be cancelled and refunded prior to Ovade beginning review of submitted materials.
Once review has begun, the service shall be considered in progress and non-refundable.
Monthly Athlete Development Program fees are non-refundable once the billing period has begun.
Clients are responsible for submitting clear, usable, relevant, and appropriate footage.
Ovade's analysis, recommendations, and feedback are based solely upon submitted materials.
If incorrect footage is submitted, replacements may be accepted before review begins.
Once review has begun, submitted materials may not be changed.
Ovade reserves the right to decline, limit, or request modification of submissions that exceed service limitations.
Ovade may record virtual consultations, assessments, coaching sessions, and video review meetings with participant consent.
Recordings may be used for:Premium Video Analysis
Public use of recordings, photographs, videos, testimonials, or other media requires authorization through a separate Media Release Agreement.
Ovade provides recruiting guidance, education, recommendations, and general information only.
Ovade does not guarantee:
All recruiting decisions remain solely within the discretion of coaches, institutions, athletic departments, and governing organizations.
Athletic development and performance are influenced by many factors outside Ovade's control.
Ovade makes no guarantees regarding:
Past performance and prior results do not guarantee future outcomes.
Ovade does not provide medical advice, diagnosis, treatment, rehabilitation, healthcare services, injury management, nutritional counseling, or mental health treatment.
Users should consult qualified healthcare professionals regarding injuries, medical concerns, physical limitations, health conditions, or mental health concerns.
All reports, analyses, recommendations, educational materials, graphics, videos, documents, resources, website content, branding, logos, trademarks, and other intellectual property are owned by Ovade Holdings LLC unless otherwise stated.
Materials may not be copied, reproduced, distributed, published, sold, modified, or publicly displayed without prior written permission.
Users agree not to:
Ovade reserves the right to restrict access or terminate services for violations of these Terms.
Ovade may utilize third-party providers including payment processors, website platforms, communication tools, storage systems, and other technology services.
Ovade is not responsible for the policies, practices, or content of third-party services.
To the fullest extent permitted by law, Ovade Holdings LLC, Ovade Athletics, its owners, coaches, employees, contractors, representatives, and affiliates shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from the use of the website or participation in Ovade services.
Users accept responsibility for decisions made based upon information, recommendations, feedback, or guidance provided by Ovade.
Users agree to indemnify and hold harmless Ovade Holdings LLC, Ovade Athletics, its owners, coaches, employees, contractors, representatives, and affiliates from claims, liabilities, damages, losses, expenses, and costs arising from their use of Ovade services or violation of these Terms.
These Terms shall be governed by and interpreted in accordance with the laws of the State of Wisconsin.
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
Ovade may update these Terms periodically.
Any updates will become effective upon posting the revised version on the Ovade website.
